Legal framework 2026

Is buying Yelp reviews illegal? The honest answer.

It is not a criminal offence in the US, UK, EU, Canada, or Australia. What exists is a civil-penalty regime, and the biggest lever is the FTC's 16 CFR Part 465 rule, which came into effect in August 2024. It authorises civil fines of up to $51,744 per fake review found by an enforcement action - but every enforcement case to date has targeted either brands writing false reviews in-house or brands paying reviewers to lie about products they never used or experienced.

Yelp's own Terms of Service prohibit compensated reviews, but a ToS violation is a civil contract matter - not a legal one. The Consumer Alert badge is Yelp's civil remedy.
